Option to object, revoke consent and delete

Right of access

You have the right to request a confirmation as to whether we process personal data about you. If this is the case, you have a right of access to the information mentioned in Art. 15 (1) GDPR, provided the rights and freedoms of other individuals are not negatively affected (see Art. 15 (4) GDPR). We will also be happy to provide you with a copy of the data.

 

Right to rectification

You have the right according to Art. 16 GDPR to arrange for personal data incorrectly stored by us (such as e.g. address, name, etc.) to be corrected. You can also at any time request that the data stored by us be completed. Said adjustment will take place immediately.

 

Right to deletion

You have the right according to Art. 17 (1) GDPR to have the personal data collected about you deleted when

  • the data is either no longer required;
  • due to the revocation of your consent the legal basis of the processing has completely lapsed;
  • you have lodged an objection to the processing and there are no legitimate reasons for the processing;
  • your data is processed unlawfully;
  • a legal obligation requires this or collection took place according to Art. 8 (1) GDPR.

The right does not exist according to Art. 17 (3) GDPR when

  • the processing is required to exercise the right to free expression of opinion and information;
  • your data has been collected on the basis of a legal obligation;
  • the processing is required for reasons of public interest;
  • the data is required to assert, exercise or defend legal claims.

 

Right to limitation of processing

According to Art. 18 (1) GDPR, you have in individual cases the right to request the restriction of the processing of your personal data.

This is the case when

  • the accuracy of the personal data is disputed by you;
  • the processing is unlawful and you do not consent to deletion;
  • the data is no longer required for the processing purpose, but the collected data serves to assert, exercise or defend legal claims;
  • an objection to the processing according to Art. 21 (1) GDPR has been lodged and it is still unclear which interests override.

 

Right to revoke

If you have given us express consent to process your personal data (Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR), you may revoke it at any time. Please note that the lawfulness of the processing carried out based on the consent up to its revocation is not affected by this.

 

Right to object

You have the right according to Art. 21 GDPR to at any time lodge an objection to the processing of personal data affecting you, which has been collected based on Art. 6 (1) (f) (as part of a legitimate interest). You are entitled to the right only if particular circumstances are opposed to the storage and processing.

Right to data portability

You have a right to the transmission of the personal data affecting you according to Art. 20 GDPR. The data will be provided by us in a structured, conventional and machine-readable format. The data can optionally be sent to you yourself or to a controller appointed by you.

We will provide the following data to you upon request according to Art. 20 (1) GDPR:

  • data which has been collected based on an express consent according to Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR;
  • data which we have received from you according to agreements existing as part of Art. 6 (1) (b) GDPR;
  • data which has been processed as part of an automated process.

The transmission of the personal data directly to a controller requested by you will be carried out by us, provided this is technically feasible. Please note that we are unable to transmit data which interferes with the freedoms and rights of other individuals according to Art. 20 (4) GDPR.

 

Right to complain to the supervisory authority according to Art. 77 (1) GDPR

If you suspect that we are processing your data unlawfully, you can of course initiate a judicial clarification of the problem at any time. In addition, you also have any other legal options open to you. Irrespective of this, you have the option according to Art. 77 (1) GDPR to contact a supervisory authority. You have the right to complain according to Art. 77 GDPR in the EU member state of your residence, your workplace and/or the location of the alleged violation, i.e. you can choose the supervisory authority that you contact from the above-mentioned locations. The supervisory authority, with whom the complaint has been filed, will inform you about the status and the outcome of your submission, including the option of a legal remedy according to Art. 78 GDPR.
